Resources for Radiation Fallout

I received an article this morning from a friend.  This is an excerpt from that article by Ilya Sandra Perlingieri.

In general I think these resources are of value, I don't always agree on her dosing choices, and usually I understand Buckwheat is fine for people with wheat allergy, because buckwheat is not actually wheat. 

When things are exposed to Cesium 137 by soil and plant contamination potassium is important. Cesium 137 is now in milk.

As she notes, we do need to continue to pay attention to what is happening and how the radiation from Fukushima is affecting us.
If you do any Spring planting, use organic seeds you may already have. Start them INDOORS, and keep them indoors. Place them near a window for with sunlight. If you plant them in radioactive soil, they will be contaminated. 
Radiation kills. This is why birth rates are also down significantly in Japan, because subsequent generations of women (after the US bombs were horrifically dropped on innocent civilians in World War 2) have had difficulty conceiving. Over the last 25 years, sperm rates have dropped 50 percent (and not just in Japan). Women also have numerous reproductive illnesses that make conceiving no longer easy. If we ever collectively saw the photographs of these heartbreaking radioactive birth defects, the nuclear industry would immediately cease to exist. The nuclear industry, built on deception, doesn’t want us to see this. This is why Dr. Helen Caldicott and Dr. Rosalie Bertell’s life-long and courageous work on the extreme dangers of radiation is so vital!
Please note these educational suggestions below are not cure-alls for radiation exposure. But it is important to support and protect your immune system, as best as possible. These are sensible precautions. If you are on any kind of pharmaceutical drug(s) or have health issues, please check first with your health care provider. 
DIET: Do not use food produced since about March 14 (the approximate date the radiation traveled to the Pacific West Coast), due to radioactive Strontium-90 [it has a half-life of 29 years] and other radioactive elements. For example, Cesium-137 [with a half life of 30 years] is chemically similar to potassium; and because of this, it can become metabolized in the body through foods, including dairy products. Do not use any fresh-grown or harvested produce, as the soil throughout the Pacific Northwest and elsewhere is now very probably radioactive. This, combined with the aerosol spraying of Chemtrails makes for a very toxic soil to grow anything. Organic whole foods are always a better choice than supplements (whenever possible), because the body absorbs and retains these foods in tissues far better. How can we have a safe food supply with such an abundance of poisons? 
Eat fresh organic apples with the skin on (and the wax rubbed off), or applesauce, bought before March 14. Drink unfiltered, organic apple juice with Bragg’s Aminos  (1 teaspoon per 8 oz for adults) [NOTE: I do not have any ties with this company]. Apple pectin is a known aid (and helped the children at Chernobyl); and it actually binds with various radioactive particles. Remember: “An apple a day…” 
Here’s my article from March 17 with some herbal recipes, one specifically for radiation exposure. It was written with consultation from more than 12 medical practitioners: 
Do NOT use any dairy products bought after about March 14. Do not eat junk food or anything containing aspartame (a toxic synthetic sweetener). 
Drink lots of steam-distilled water! If you have a reverse-osmosis filtering system, this is also beneficial. This process eliminates bacteria, viruses, pollutants, and many chemicals. Unpurified city water may contain unknown quantities of chlorine, fluoride, or other sources of contaminants. You can add flavoring to this water with 2 Tablespoons of raw apple cider vinegar per 1 gallon of steam-distilled water. Vinegar also helps with digestion. 
Elderberry Syrup (in a glass bottle) is a great support for the immune system. Elderberries are a terrific all-around “medicine chest.” Children under 12 could take 1/4 teaspoon daily for the next 2-3 months. Children under 6 could take 1/8 teaspoon daily. It tastes delicious.  
The best oils to use are cold-pressed organic olive and safflower oils. Coconut oil is also good for cooking and can be used topically for the skin, to help with dry skin. Avoid other kinds of oils. 
Avocados and lemons help supply essential fatty acids that the body needs –again provided they are not contaminated! Find out where they were picked and when. Don’t shop on “automatic pilot” now. Do your homework and become an educated and informed citizen. Shoppers are not citizens. 
Lemon-honey-fresh ginger-root tea is good daily drink. Use 2-3 very thin slices of ginger root per cup of boiled, steam-distilled water. (Powdered ginger root also works, but fresh is better.) Add honey and lemon to taste. For children, serve it warm or room temperature. Lemons are also a delicious way to flavor steam-distilled water and help with digestion. 
Organic bee pollen (again check about the harvest date) is anti-microbial and has vitamins B and C, calcium, potassium, magnesium, enzymes, and plant sterols. It helps with stress, fatigue, and is a tremendous support for the immune system.  
Buckwheat flour (for those who are not wheat intolerant) has rutin, and this also helps protect against radiation. 
EAT LOTS OF GARLIC daily! This is long known to protect the immune system. Tumeric is also a good anti-inflammatory and a great spice to use regularly in cooking. 
Medicinal organic mushrooms (picked before March 14, or dried): maitaki (a marvelous adaptogen, and it has been shown to inhibit cancerous growth), shitaki, trumpet, morels, all are excellent. There might be good dried ones available. Make the following: sauté 1 diced red and 1 diced yellow onion in organic, cold-pressed olive oil. Add diced mushrooms and mashed fresh garlic. Cook on low flame for about 10 minutes. Serve with pasta or over mashed potatoes. This helps support your immune system. 
Vitamin C daily with bioflavinoids [this helps with C absorption] and rutin: Adults: 2-3 grams daily. DO NOT USE any oranges, lemons, or grapefruit (or other citrus) coming from any US southern state, due to the Corexit dispersant spraying for months (over land, too), since the Gulf of Mexico oil-rig explosion in April 2010. No testing has been done to see about any very real synergistic interactions among this deadly dispersant (that has contaminated the entire Gulf of Mexico region), aerosolized Chemtrails toxins, and radiation. 
Vitamin B-Complex: For adults, 50 mg (max) of each of the major B vitamins (B-1, B-2, B-5 [called the “anti-stress” vitamin], B-6, and B-12) The B-Complex aids in supporting your body’s nerves, skin, eyes, mouth, liver, and hair to maintain their health. This also helps with anxiety; and this may be particular useful now with little information on the extreme gravity of exactly what invisible radioactive hazards we all face. Good sources of natural B include: burdock root (often found fresh), chamomile, raspberry leaves, brussels sprouts, broccoli, parsley, kelp [Atlantic and dried], watercress, dandelion greens, nuts, mushrooms, molasses, eggs, and rye flour. 
Vitamin-A with mixed carotenoids. This helps not just with night blindness but also various other eye problems. This is particularly useful now with the use of EDB [Ethylene dibromide, a highly poisonous chemical], the desiccant in Chemtrails. Vitamin A maintains healing of the skin, mucous membranes, and bone formation. Some carotenoids act as antioxidants (that aid in the prevention of cancer). 
Vitamin D: Due to a 20-percent drop in available sunlight, because of aerosolized blanketing of our poisoned skies, we are now running at a Vitamin D deficiency. 1,000 mg of Vitamin D-3 daily for adults is needed. 
Vitamin E: natural sources (gel caps most often come from Genetically Engineered sources) include: cold-pressed olive oil, seeds, nuts, whole grains, sweet potatoes, dandelion, nettles, and rosehips.  
Coenzyme Q-10. This helps prevent the body from absorbing radioactive materials. This is actually produced by our body’s tissues; and it helps support the immune system to prevent cardiovascular disease. Co-Q10 also has been used for decades by the Japanese for patients with cancer and leukemia (both epidemic since the US dropped the bombs on Hiroshima and Nagasaki during WW2). It also helps protect the heart. 
 Avoid using cellular phones. This already damages brain function. There are numerous reports on this. DO NOT LET the children use a cell phone! There are more than 4-billion cell phones in use worldwide. This technology was never tested for safety before billions of people became addicted to its use. We now have an epidemic of glioma cancers [a specific type of brain cancer that used to be rare, due to the use of cell phones. It is what killed Senator Kennedy, and two of my own friends.] 
Zinc lozenges [OptiZinc has best absorption. Again, I have not financial ties.]
Kelp [Not from Pacific Ocean or Japan!] , 1,000 mg daily for adults; or a 1/2 teaspoon daily sprinkled on food.  
Fresh Miso in soup [again not from Pacific or Japan] 
Here’s a post from two scientists. They still think it is a fixable scenario. IT IS NOT! However, the photos they have show clearly how dangerous this on-going catastrophe is. These are the best shots I have seen so far. This will go on not for weeks, but YEARS! As I have just written, this is far worse than Chernobyl!

New Ways to Access Your Health Data

The data miners never take a day off.  And when it comes to getting your health and other personal information it seems they will stop at nothing.

Now some one has dreamed up the new Health FICO score so they know if or when you are follwoing doctors' dictates.

My concern of course is that in this mdel there is nothing to call to the fact that too many health care provider's faile to engage you in informed consent.

Hands on Healing for Pain and So Much More

Reading news early this morning I came upon a couple of article that were of interest because they involved energy healing.

One was from the Milwaukee Journal Sentinal. The article described a difficult situation for a woman, and it did discuss some troubling behavior by this practitioner. However, in general my feeling was that it was generally negative toward healing. The writer actually interviewed no one that could shine some positive light on this type of work.

Here are my comments to the writer -
The second article that caught a bit of my ire came from Everyday Health.
I just wanted to comment that while you article is good it hardly seems fair as it paints a negative picture of all intuitive healers.

I have the sense to know what is wrong with people by looking at them. I do not however do any type of work similar to what the man did in your article. He was certainly out of bounds and for this he should be prosecuted.

Spinal manipulation is not always chiropractic. Medical providers that specialize in osteopathy can do this and the new hybrid type of naturopaths do this as well. Even some physical therapists licensed massage therapists do this too as you mention.

There are specialized chiropractors that do use a very fast and forceful type of adjusting. I have experienced it and I do not like it. I am however an advocate of chiropractic for many situations.

I hate to counter Dr. Sampson but he is totally incorrect about the lack of scientific studies into healing. However this is the medical closed-mind set and it is also the same of the US government (bias) even though there is an office of alternative health. His attitude is clear when he refers to all of this as *quackery*.
I am a bit surprised that you did not make an effort to talk with Barbara Brennan. You would find a great amount of science behind healing if you had contacted her. There are many other sources, including MDs that write on this subject and do study it. I began studying this area in 1972 and many of my teachers were medical professionals.

I will tell you though that bureaucratic attacks on people by state departments can be extremely egregious and corrupt. I am not surprised at the record in your state.

Patient records ARE the property of the "patient": Destroying them or being advised by an attorney not to give them to a person about whom the record is written is violation of patient rights and regulations covering health related records. Maybe this woman should file a bar complaint against Wu's attorney and seek recovery from him for obstructing justice.

I'm a longtime Reiki Master, teacher, and practitioner.  In general I thought this article too was slanted to the negative.  The other concern I had too when reading it was the fact that it stressed "that standardization is lacking" in the United States.  

Since Reiki is a practice that facilitates energy, it is not "similar to massage", and it is very much based on following the lead of the person receiving the treatment.  In this sense standardization would defeat the purpose of this ancient healing technique.

The article made some good points, but it labelled Reiki as "alternative medicine" which it is not.  

What are your thoughts?

Coconut Oil Protects Against Environmental Toxins

In the largest study of chemical exposure ever conducted on human beings, the U.S. Centers for Disease Control and Prevention (CDC) reported recently that most American children and adults are carrying in their bodies dozens of pesticides and toxic compounds used in consumer products, many of them linked to potential health threats.

The report documented that children carry bigger doses of many chemicals than adults, including some pyrethroids that are ingredients of virtually every household pesticide and phthalates found in nail polish and other beauty products as well as in soft plastics.

The study looked for 148 toxic compounds in the urine and blood of about 2,400 people over age 5. CDC director Julie Gerberding called the national exposure report, “the largest and most comprehensive report of its kind ever released anywhere by anyone.” Environmental health experts say the discovery of more than 100 chemicals in human bodies is of great concern because we don’t know what effect they can have on the body. Many environmental health experts believe the rise in cancer and other chronic diseases over the past several decades is due, in part, to the accumulation of these chemicals in our bodies.

However, removing pesticides, plastic bottles, make-up, and other items won’t be happening anytime soon. The best solution to the problem is to remove the toxins from our bodies. Certain foods such as cilantro, wheat bran, and coconut have detoxifying effects that can absorb or neutralize environmental chemicals that collect in our bodies. Simply adding these detoxifying foods into the diet can help eliminate many of the toxins we are exposed to each day.

Coconut oil is of particular interest because it has been shown to be highly effective in neutralizing many environmental toxins.

A recent study published in the journal Human and Experimental Toxicology (August 2005) revealed the effectiveness of coconut oil in neutralizing aluminum phosphide, a poison used in rodent control. A case study reported a 28-year-old man ingested a lethal amount of the chemical in an attempt to commit suicide. There is no known antidote for aluminum phosphide poisoning. Doctors had little hope of saving him. He was given the standard treatment for acute poisoning as well as the oral administration of coconut oil. To the surprise of the medical staff, the patient survived. The authors of the study recommend that coconut oil be added to the treatment protocol in acute poisoning cases.

Using coconut oil to help nullify the effects of a poison is not as strange as it may sound. Researchers have known for over a decade about the detoxifying effects of coconut oil. In my new book Coconut Cures: Preventing and Treating Common Health Problems with Coconut, I cite several studies where coconut oil has been shown to neutralize a variety of toxins, including the deadly aflatoxin.

Aflatoxin is a very potent poison that comes from a fungus that often infests grains, especially corn. In Asia and Africa, aflatoxin is a serious problem. Corn has been found to be the most aflatoxin-contaminated food eaten in the Philippines. In certain areas of that country, corn consumption is high. A correlation exists between the incidence of liver cancer caused by aflatoxin and the amount of corn consumed. Those people who eat the most corn also have the highest rates of liver cancer. Coconut oil consumption appears to protect the liver from the cancer-causing effect of aflatoxin. The population of Bicol, in the Philippines, has an unusually high intake of aflatoxin-infested corn, yet they have a low incidence of liver cancer. The reason for the low cancer rate is believed to be due to the high coconut consumption in the area.

Using coconut oil in your daily diet can help protect you from a variety of environmental toxins. An easy way to add coconut oil to your diet is to use it in your cooking in place of other fats and oils. If you don’t use much oil in food preparation you can take it by the spoonful like a dietary supplement. A quality brand of coconut oil tastes very good and is even pleasant to eat straight from a spoon. I often put a spoonful of hardened coconut oil in my mouth and let it slowly melt. It’s an easy way to get my daily dose. SOURCE

Bacteria, Cancer, and GERD

This article caught my eye because I know people that have had to deal with this health problem.  My concern is about the over use of acid blocking drugs which are known to lead to cancer and also to reduction of hydrochloric (HCl) acid in your stomach. 

The acid problem is of concern because it may really be with reflux that you do not have enough stomach acid.  This is very true as you age and also if you are taking too many prescribed drugs (Are you prescribed an acid blocker for all your Rx?)

Acid blocking drugs also create a risk for infection and illness because of the reduced HCl, something that is part of your immune system.  Get sick too often when on these drugs?  Get food poisoning?

Do you have a wheat allergy?  The connection between Barret's and wheat allergy has been well established for decades.

Barrett's esophagus (BE) is a complication of chronic gastroesophageal reflux disease, in which patients are at greatly increased risk of esophageal dysplasia and adenocarcinoma. Over the past 2 decades, there has been an increase in the incidence of both BE and adenocarcinoma; however, the involvement of microorganisms in BE is uncertain. The aim of this study was to characterize microbial communities in esophageal aspirate specimens and on distal esophageal mucosal samples from patients with BE.


Biopsy and aspirate specimens were obtained by endoscopic examination from 7 patients with BE and 7 control subjects without BE. Samples were cultured under aerobic, anaerobic, and microaerophilic conditions for yeasts and bacteria, including Helicobacter pylori. Bacterial isolates were identified by 16S ribosomal RNA gene sequencing. Fluorescence microscopic examination was also used to determine the spatial localization of these organisms on mucosal surfaces. Significant colonization was detected in 6 patients with BE and in 4 control subjects.


Overall, 46 bacterial species belonging to 16 genera were detected, with 10 species being common in both groups. Both aspirate and biopsy samples from patients with BE contained complex populations of bacteria. Uniquely, high levels of Campylobacter species (Campylobacter concisus and Campylobacter rectus), which have been linked to enteritis, periodontal infections, and tumor formation in animals, were found in 4 (57%) of 7 patients with BE but in none of the control subjects. Microscopic examination revealed that bacteria on mucosal biofilms often occurred in microcolonies.

Instant Replay: Fluoride & Green Tea

For many years I served as a medical adviser with a group that educates about and researches on the topic of fluoride.  They do this because fluoride is a very toxic substance.

Over the years your exposure to fluoride has grown in many ways that to most are not considered.  To this end you will find many articles at Natural Health News about the fluoride issue.

My advice is to learn all you can and protect your self from overdosing on this very poisonous halogen group member.

If you follow this blog and our other web work you may know that I have frequently spoken out against green tea, especially as it is marketed to be the panacea of the world.

I do drink green tea from time to time, but very infrequently.  I like Pu'erh tea as well which is a fermented green tea.

I picked up on this today when the "Supermarket Guru" talked about an interview he was doing with an MD on Pu'erh.  While some reports show that Pu'erh may drop cholesterol levels that might not be your biggest need to know more about this topic. Clearly nothing was mentioned about the fluoride concern.
Here is what I stress about fluoride and green tea-

Overdoing green tea can lead to pancreatic cancer but few report this.

FDA Approves Remicade for Kids with Ulcerative Colitis

This is news just out about 6 PM PDT.

If you are like me and you think what this indicates then you have an idea of my concerns.  If you aren't like me here are a few of my concerns -
First of all I have to ask just why is a *kid* getting UC.  Then I ask, why do you need to select a drug that is genetically engineered and one that costs up to $25,000 a year and is administered by IV (intravenous).
Next think about the risks of the drug -

Now just why are you prescribing this drug to a group that you -at the very same time - 
are you placing at risk for lymphoma and other cancers?
Seems to me that this is a very risky experiment for the benefit of Big PhRMA more than it is for a child, and their parents.

If you read the info it almost sounds like a vaccine, so maybe you should think about just why it might be a vaccine that causes the UC in the first place.  And now you want to impair a fragile immune system once again...
What about food allergy?
What about astragalus and marshmallow root?
What about flax seed oil?  (Something I have used very successfully for people with UC)
And of course there are quite a few other things you might do first, and if that is the case then look to Health Forensics to give you some sound suggestions.
Suggestions that do not increase your risk of lymphoma and other cancers.

CHICAGO (AP) — This week's heat wave may be uncomfortable, but you're healthy, active and feel just fine. So what if you're over 65? Think again. Feeling good doesn't mean you're safe.

There are changes in an older person that raise the risk for heat stroke and other problems. An older body contains far less water than a younger one. Older brains can't sense temperature changes as well, and they don't recognize thirst as easily.

Blistering summer heat is an underappreciated killer, claiming by some estimates as many as 1,000 U.S. lives each year — more than any other type of weather.

One federal study found 40 percent of heat-related deaths were in people 65 and older. Those numbers could be lower if more heeded heat warnings aimed at seniors. Yet research has shown many people over 65 don't think the warnings apply to them — because they don't think they're "old."

Don Worden is 79 and an avid tennis buff who prefers playing doubles on outdoor courts along Chicago's lakefront — even in oppressive 90-degree temperatures like those hitting the Midwest this week.

"I don't pay too much attention to those" warnings, Worden said. "I stay in pretty good shape, and I don't feel they apply to me."

Worden said he drinks a lot of water and would stop a match if he started feeling effects from the heat, "but that hasn't happened."

Scott Sheridan, who studies the effects of heat and climate on health at Kent State University, researched how people over 65 view heat warnings. In his 2006 study of more than 900 people, he found about 70 percent knew about advice to drink plenty of water on very hot days, avoid outdoor activities and stay inside with air conditioning. But only about half said they followed the advice.

"People well into their 70s would say old people should watch out but not them," he said. "People just didn't want to be thought of in that same category."

Dr. David Zich, an emergency medicine specialist at Northwestern Memorial Hospital, said he has colleagues in medicine that age who shun being thought of as "elderly." But those heat warnings apply to them, too.

As Dr. William Dale, geriatrics chief at the University of Chicago Medical Center explains it, "Any older adult has less reserve and is more likely to become dehydrated than others, just because their overall body water goes down with age no matter how healthy you are."

The amount of water in the body declines with aging, from about 80 percent in young adulthood to about 55 to 60 percent for people in their 80s, Dale said.

Temperature sensors in the brain become less sensitive as people age, so the body doesn't get the same signals to drink water in hot weather, and older people often don't feel thirsty even when they need to replenish, Dale said.

They also may not feel the typical symptoms of dehydration, such as headache or dizziness. Some complain of just feeling "bad" and think they're getting sick, he said.

Conditions were ripe for those types of complaints Tuesday as a dense dome of hot air remained parked over much of the nation's midsection, raising temperatures into the mid- to upper-90s from the Texas Gulf Coast to the Rockies and the northern Plains. Tropical-level humidity raised the heat index in many places to nearly 120 degrees.

In South Dakota, up to 1,500 head of cattle died across the state from the heat. And in eastern Iowa, the scorching sun caused a portion of Interstate 380 to buckle. The weather also sent dozens of people to hospitals, canceled outdoor sporting events and caused sporadic power outages.

In such conditions, dehydration can lead to heat exhaustion and potentially deadly heat stroke. During a heat wave, that can happen in a matter of hours in older people if they over-exert themselves, don't drink enough water or are frail and don't get out of uncooled homes, said Dr. Chris Carpenter, an emergency medicine physician at Washington University School of Medicine in St. Louis.

Heat exhaustion can cause muscle cramps, low blood pressure, rapid pulse and nausea. It can be treated at home, by drinking water, getting into an air-conditioned room or sitting in front of a fan and misting the body with cool water.

But affected people should be monitored for mental changes and to make sure their temperature does not rise above 102 because the condition can quickly lead to heat stroke. A medical emergency, heat stroke involves temperatures of 104 or higher and can cause seizures, loss of consciousness and death.

Medicines many older people take also may make them more vulnerable to the heat. These include diuretics for high blood pressure, which increase urination — and make it more important to drink plenty of water, Dale said.

Some types of drugs can interfere with sweating and raise body temperature, including some medicines for insomnia, nausea, prostate conditions, Parkinson's disease and even Benadryl. Many list "dry mouth" as a side effect — a tip-off to drink more water, Zich said.

There aren't specific guidelines on how much water older people should drink in a heat wave.

Dale said he generally tells his older patients to drink a quart of water throughout the day, and to drink even if they don't feel thirsty.

Doctors also advise older patients to avoid alcohol and coffee during extreme heat because they can cause the body to lose fluid and contribute to dehydration.

Write the FDA Now - Here's Why & How

Everyone with even an ounce of common sense has grave concerns about the U.S. Food and Drug Administration’s recently released Draft Guidance for Industry: Dietary Supplements: New Dietary Ingredient Notifications and Related Issues. This Agency sprang this trap on both industry and consumers without seeking any prior input from us at all. It had almost 17 years to seek our opinion before coming out with this document, and now they are giving us a miserly 90 days to respond with our comments. Why is this issue so important?

The Erosion of Our Health Rights

When the Dietary Supplement Health and Education Act of 1994 (DSHEA) was passed, contrary to what the mainstream media falsely reports, the law did not remove dietary supplements from the regulatory oversight of the FDA. What it did do is to remove the FDA’s arbitrary powers of life and death over supplements so that they could be treated more like foods rather than as drugs. The innovative tidal wave that was unleashed as a result of this breakout from regulatory prison resulted in some 1,000 new products a year in this market. What an incredible difference DSHEA made, and we all benefitted from the prison break. Oh, wait, the FDA’s drug-industry bosom-buddies did not benefit. And that is something they have never forgotten and have been fuming over ever since.

Not without their cohorts in U.S. Congress, the drug industry’s lobbyists have been pushing for years to hamstring DSHEA and its freedoms. For more than a decade, they have failed. But for the last several years, they have succeeded with sausage-slicing tactics that have gradually eroded DSHEA. First, there was the Adverse Event Reporting law, then the law mandating “Good Manufacturing Practices,” and after that came the so-called FDA “Modernization” Act – each one designed to ratchet up the pressure on supplements, to drive out the smaller supplement manufacturers who could not keep up with the increasing regulatory costs demanded of them by these laws that were touted as making already-safe supplements “safe,” and to gradually eliminate individual supplements. Were these laws ever truly designed to protect consumers? No, these laws had only one purpose in mind: To make supplements more expensive, less available, and to drive the consumer back into the filthy arms of the drug pushers.

This latest nonsense is straight out of the warped minds of the FDA’s Berchtesgaden nest of anti-health thugs. They could care less about good health, certainly care less about you or me. This has been proven so many, countless times over the decades of the Agency’s existence that there can no longer be even a shred of doubt. The revolving door between the drug industry and the FDA is a never-stopping one. Just witness its recent hiring of Johnson & Johnson’s executive Spielberg who was tapped by FDA Commissioner Margaret Hamburg, as the latest deputy commissioner within the Office of the Commissioner to oversee the Agency’s drug and device centers. This is not an exception, this is the rule.

The Compromise

Unfortunately, when DSHEA was passed, a compromise was reached in order to get unanimous passage. The parties agreed that all dietary supplements not marketed as of the date of DSHEA’s passage (October 15, 1994) would be “new dietary ingredients” (NDIs) for which notification would be sent to the FDA. At the time, some did not think much was wrong with this compromise. After all, most supplements had already been discovered. But, now, almost 17 years later, the health-food market is awash with these new dietary ingredients, such as resveratrol, ubiquinol, GABA, curcumin, and bioperine. Notifications to the FDA have been made for many, but what is to happen to them now, with the FDA changing the law, all on its own?

Fantasy Land
This draft Guidance is a step into fantasy land. One night the FDA went to sleep and had a wonderful dream, a dream about a land where bureaucrats reigned supreme and the common citizen answered to every edict that flowed from the lovely bureaucrats’ mouths. If the bureaucrat said jump, then the citizen would jump; if the bureaucrat said roll over, then the citizen would roll over. It was a wonderful place, this bureau-paradise. But then the FDA woke up, and the non-dream reality was not nearly that perfect, yet the urge to make it bureau-perfect remained. Hence, these constant bureaucratic attempts to whittle down our freedoms until we can only jump to the tune of some unknown functionary sitting in some unknown office thinking that he or she knows better for us than we do.

This draft Guidance is just such an attempt. It turns the law on its head by changing a very basic notification system into an approval system subject to the arbitrary whims of the FDA. It requires very safe NDIs to go through unnecessary, expensive tests so that they can meet drug-like safety requirements. In essence, this Guidance ignores the incredible, proven safety record of supplements, both new and old. The FDA can produce no dead bodies whatsoever coming from the use of these new dietary ingredients.

Yet the FDA, ignoring the many tens of thousands of actual dead bodies coming from its expensive drug-approval regulatory regime, wants to imprint that badly flawed drug-approval regime upon the dietary-supplement market. In doing so, it ignores the clear intent of Congress when passing DSHEA that “the Federal Government should not take any actions to impose unreasonable regulatory barriers limiting or slowing the flow of safe products and accurate information to consumers” and that “the right of access of consumers to safe dietary supplements is necessary in order to promote wellness.”

Flood Them with Letters
The Guidance document is not law, but it is a clear expression of how the FDA intends to enforce its interpretation of the law. This interpretation is badly flawed. And its implementation will result in unnecessary high costs, arbitrary discrimination against small- and medium-sized businesses that will put thousands of people out of work by destroying jobs in a time of economic decline, and the loss of many useful and healthful supplements.

The FDA must withdraw this Guidance document at once, consult with industry and consumers on a longer-term basis than this miserly 90-day period, and come out with a new Guidance that better reflects the realities of the marketplace and the safe track record of supplements, including those with NDIs. The FDA’s proposed document is unauthorized under Law and will guarantee a backlash of legislative action the likes of which have not been seen in this legislative arena since the passage of DSHEA in 1994. The NHF suggests that the cut-off date for NDIs either be eliminated entirely or else pushed forward to a date 15 years after 1994.

Please mail, fax, or e-mail your protest letter ( Click Here for Sample Letter) to the FDA as soon as possible, but in no event later than October 1st of this year. They need to be awakened from dreamland.
